Mintz Levin hosts Electronic Monitoring Breakfast Briefings

In January and February, Mintz Levin hosted breakfast briefings in four cities on the choices and legal challenges employers face with respect to monitoring employees in the workplace, "Electronic Monitoring and Electronic Disclosure in the Workplace: Choices and Challenges for Employers." The breakfasts took place on consecutive Tuesdays: February 11 in Boston; February 4 in Reston; January 28 in New Haven; and January 21 in New York.

The agenda included:

  • a discussion of employee rights to privacy in the workplace;
  • specific laws governing monitoring in the workplace, including the Federal Electronic Communications Privacy Act and applicable state laws;
  • steps an employer can take in the event it finds evidence of employee wrongdoing through monitoring, including reductions in compensation;
  • electronic disclosure in the workplace; and
  • benefits and executive compensation update.
