Boston, MA – Lisa Glahn a member of the Litigation Section of Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C., recently spoke before the Boston chapter of the National Association of Women in Construction (NAWIC) on Massachusetts' recently enacted "Prompt Pay" law.
Ms. Glahn, who practices in the firm’s Construction Law Practice Group, was part of a panel discussion on "An Act Promoting Fairness in Private Construction Contracts," which was signed into law by Massachusetts Governor Deval Patrick in August of 2010 and became effective last November.
The "Prompt Pay" law, as it is referred to, requires that private contracts executed after November 8, 2010 process and pay change order and payment requests by a mandated deadline. The law specifies that if contractors and subcontractors are not paid in a timely manner, they will be allowed to stop work regardless of contract provisions that require dispute resolution to wait until the completion of the contract.
The seminar, which was attended by approximately 30 construction industry professionals, was held February 15th at the Courtyard Marriott in Cambridge, Massachusetts.
Ms. Glahn represents contractors, developers and project owners in both the public and private sector including litigating and resolving several multi-million-dollar disputes on public projects such as the MWRA's Deer Island Outfall Tunnel Project, the Boston Central Artery's Ted Williams Tunnel Finish Work Project, the East Lynn CSO Design/Build Project and the Wachusett Aqueduct Rehabilitation Project. She also counsels clients on all aspects of procurement law, project development and claims procedure, and has developed an expertise in dealing with complex, multi-party claims disputes involving issues related to defective work, termination, mechanic's liens, differing site conditions clauses, pay-if-paid provisions, and surety and insurance coverage.
