Mintz Levin Achieves One of the Largest Bench Awards in Massachusetts in 2005

Boston, MA - Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C. today announced that the firm's victory in the case of Giuliano v. Plainville Racing Company, et al is the fifth largest bench award in 2005 according to Massachusetts Lawyers Weekly.

In August 2005, Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C. attorneys secured a significant legal victory on behalf of Gary Piontkowski, former Chairman of the Massachusetts State Racing Commission, and his company, the Plainville Racing Company, in a complex trial against real estate developer Louis J. Giuliano and his Massachusetts company GTWO, which involved allegations of fraud, document manipulation, and diversion of construction funds for personal purposes.

After a six-week bench trial in the Business Litigation Session of the Suffolk Superior Court, Judge Margot G. Botsford dismissed all of the claims brought by Mr. Giuliano, and entered judgment in favor of Mr. Piontkowski and the Plainville Racing Company, finding that they were entitled to recover a total of $2.1 million in damages and attorneys fees. In rejecting Mr. Giuliano's allegations, the Court found that it was Mr. Giuliano who had knowingly and intentionally defrauded Mr. Piontkowski and the Plainville Racing Company, and had committed deceptive and unfair business practices in violation of Massachusetts law.
