Trademark & Copyright

Read our blog - Copyright and Trademark MattersMintz Levin has substantial depth and expertise in securing and protecting trademarks and copyrights. Drawing on diverse experience, both in private practice and at the United States Patent and Trademark Office (USPTO), and from active membership in the International Trademark Association and other professional organizations, our attorneys effectively represent clients before the USPTO, in federal and state courts, and before regulatory and administrative agencies, including trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board. This expertise, coupled with a broad network of foreign associates in over 120 countries throughout the world, enables us to provide strategic assistance to clients on both domestic and international trademark matters.

Our attorneys are also well versed in assisting clients with copyright issues, including selection, acquisition, clearance, protection, and enforcement of copyrights. We counsel clients on transactional issues, due diligence, audits, ownership of copyright, obtaining registrations at the U.S. Copyright Office, work-for-hire, and related issues.

For most businesses, having an effective and easy-to-find Internet presence is crucial. Domain names, as a result, are often highly valued company assets. We assist clients in the selection, procurement, protection, recovery, and enforcement of domain names. Our attorneys are well-versed in the Uniform Domain Name Resolution Policy, and have arbitrated numerous domain name disputes before the World Intellectual Property Organization and the National Arbitration Forum. Our attorneys are also fully equipped to counsel clients on how best to protect their brands on the Internet. We have advised our clients on issues relating to keyword and sponsored link advertising on search engines, as well as challenges to brand protection posed by social media sites.

Our attorneys are also experienced in enforcing our clients’ trademarks, trade dress, trade secrets, and copyrights. We work with our clients to develop appropriate strategies on how best to protect valuable IP, carefully considering the best timing for litigation, the appropriate forum, and the possibility of mediation or arbitration. We have successfully handled numerous trademark, trade dress, trade secret, and copyright infringement cases, as well as domain name disputes, in federal and state courts across the country.

Our attorneys are frequently invited to speak and write, both in the United States and abroad, on topics of interest to trademark owners, and have guest-lectured at universities throughout the country. We have appeared as IP specialists on Court TV, commented on IP topics for national newspapers and radio outlets, and testified at hearings before state legislatures and the U.S. Congress. In addition to serving as faculty members at trademark, copyright, and IP seminars worldwide, our attorneys have contributed chapters to IP books and treatises, and regularly publish articles. One of our attorneys also sits by appointment on the advisory boards of several international IP publications.
