Benefits Article: Anatomy of a Paradigm Shift: An Overview of the Deferred Compensation Provisions of the American Jobs Creation Act of 2004

Among (many) other things, the American Jobs Creation Act of 2004 substantially rewrote the rules governing all sorts of deferred and executive compensation arrangements. We are pleased to provide you with a copy of a comprehensive article on the subject, entitled Anatomy of a Paradigm Shift: An Overview of the Deferred Compensation Provisions of the American Jobs Creation Act of 2004, recently published in Tax Management Compensation Planning Journal (published by the Tax Management, Inc.). The article was written by Alden Bianchi, who chairs the Firm's employee benefits and executive compensation practice.

Congress directed the IRS and the U.S. Department of the Treasury to issue guidance fleshing out these new rules. Some of the guidance is out (and is discussed in this article), but there is a great deal more to come. Updates will be posted from time-to-time to the Firm's website.
