Benefits Advisory: The Final (and Proposed) IRS, DOL and HHS HIPAA Portability Regulations

The Internal Revenue Service, Department of Labor and the Department of Health and Humane Services recently issued final HIPAA portability rules. The new rules make few changes to the 1997 interim rules, but they include some important clarifications. Proposed rules dealing with breaks in coverage, FMLA leave, special enrollment, and the number of plans in issue were issued along with the final rule. This advisory summarizes the important features of the final and proposed rules.
