Business Client Alert: Are You Ready for California's New Data Sharing Law?

The new privacy and data sharing law takes effect in California on January 1, 2005, will likely have wide-reaching effects and require some level of compliance by businesses nationwide. S.B. 27 (California Civil Code Section 1798.83) is informally called the "shine the light" act (the "Act") and it imposes specific disclosure and notice requirements on businesses that share customers' personal information with others for marketing purposes. It also requires companies to notify these customers of their ability to request information about such disclosures, and to provide a means of submitting requests for information. The Act does not regulate or restrict the disclosure of personal information. It does, however, impose significant new obligations on companies that do share personal information with affiliates or third parties.
