Claims Trading Article

This article, written by Mintz Levin Attorneys Richard E. Mikels and David Hadas, discusses the case law development in the area of bankruptcy claims trading. After a discussion of the requirements of the bankruptcy rule which relates to claims trading, the article addresses the law with regard to claims trading by parties with confidential or non-public information, claims trading in aid of hostile takeover bids or in defense of confirmation of plans of reorganization, and finally, claims trading to obtain "party in interest" standing.
