Patrick Clendenen and Joseph Lipchitz co-authored "Domain Names As Property," Chapter 17 in West Publishing's comprehensive guide to Internet Law and Practice. The article describes the domain name system and technology; explains who the past and present administrators are; and discusses legal issues such as breach of implied duty of good faith and fair dealing, and in rem property. Examples of real conflicts involving domain names are used to illustrate potential difficulties.
