Vapor Intrusion: Invisible Menace to the Bottom Line

Real Estate Finance Journal
9/2007
Susan Phillips

Until recently, environmental regulatory agencies focused on cleanup of soil, groundwater, surface water and sediment, and rarely examined the pathway into indoor air as a separate issue. Now, an increasing focus of environmental regulatory agencies - vapor intrusion - presents a concern to anyone owning, buying, leasing, developing, financing, or investing in property. Vapor intrusion is the migration of chemicals from the ground (soil or groundwater) into buildings. The possibility of vapor intrusion could set in motion a costly and time-consuming regulatory process that lacks the degree of certainty now more typical of soil and groundwater remediation.

In this article, published in the Fall 2007 Real Estate Finance Journal, Mintz Levin attorney Susan Phillips highlights the importance of including vapor intrusion in thorough environmental due diligence.
