The ADA Amendments Act’s regulations become effective today, and all employers should review how they handle disability issues in the workplace in order to ensure that they are in compliance. The regulations expand ADA’s coverage, simplify the determination of who has a “disability,” and shift the focus from the employee (and his/her burden to prove a disability) to the employer (and its burden to make a good faith effort to reasonably accommodate the employee). This alert provides details and analysis of the regulations as well as employer action items.
