Public Finance Alert: Recent Developments Regarding Issuer Responsibility for Reviewing Initial Offering Prices of Bonds

Following the introduction of the Build America Bonds, the IRS has demonstrated an increasing interest in scrutinizing municipal bond trade data. Given the availability of live trade data on the Municipal Securities Rulemaking Board’s EMMA website, bond issuers would do well to review trading data and to raise any questions relating to initial offering prices with their underwriters and bond counsel.
