The Bureau of National Affairs has published the "Stark Phase III Regulation—Analysis and Comment" article written by the attorneys in the Health Law Practice of Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C.

The BNA had previously asked Mintz Levin attorney Tom Crane and its Health Law Practice, to prepare an analysis of the new physician self referral regulation, known as Stark III, issued by HHS's Center for Medicare & Medicaid Services (CMS). The Stark law prohibits physicians from referring Medicare patients for "designated health services" to entities with which they have a financial relationship not protected by an exception. CMS makes important changes to the Stark regulations, and because strict compliance with these rules is so important, a thorough understanding of them is essential.
