Immigration Client Alert: H-1B Numbers Going at Exponential Rate; Australians Receive Good News Regarding E-3 Visas

5/22/2006

On Thursday, May 18th we sent out an Alert regarding last week's announcement by the Department of Homeland Security's Citizenship and Immigration Services (USCIS) relating to the usage of this year's (FY2007) H-1B visa numbers, and we indicated that these numbers are running out very quickly. To underscore this point, on Friday, May 19th, USCIS released yet another announcement regarding the continuing depletion of these numbers. Friday's update published by USCIS shows that over the course of four days last week, 4,637 H-1B numbers were allocated, leaving only 18,755 remaining for FY2007 which commences October 1, 2006. As of May 19th, an additional 14,952 H-1Bs remained available for those who have an advanced degree from a US university. If this rapid pace continues, the H-1B cap could be reached within three weeks (and for those with advanced degrees from US universities, the numbers could be depleted by October 1.) The message is clear: if you have potential H-1B job applicants in your pipeline, immediate attention must be given to filing H-1B petitions before the cap is reached.
